Warranties
What is warranted under this Rebuilt Engine Limited Warranty (“contract”)
- Timbukthree 4WD provides a limited warranty for its rebuilt engines (referred to simply as “engine” below) against knock, cracked block, cracked cylinder head, and excessive smoking for the specified warranty period starting from the Warranty Effective Date. This is a Parts ONLY Warranty.
- Although the seals and gaskets for the engine are all new, Timbukthree 4WD does not warrant them at all.
- This limited warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
This is a limited warranty
- The limited warranty described above is for the time period specified in your purchase paperwork.
- Timbukthree 4WD rebuilt engines consist of the following: Engine block, crankshaft, connecting rods, pistons, piston rings, bearings, cylinder head with valves & springs, oil pump, oil pickup, oil filter adapter (if applicable), camshaft, timing set, timing cover, harmonic balancer/damper, valve cover, oil pan, oil dipstick, freeze plugs; and the following gaskets: Valve cover, cylinder head, thermostat, water pump, intake/exhaust, distributor, timing cover, oil pan, front crank seal, and rear main seal.
- Any and all necessary warranty repairs to the engine under either warranty must be made by Timbukthree 4WD and will be made free of charge if Timbukthree 4WD verifies the root cause of the issue is related to the engine itself. If the repairs are performed by any other person or shop, you will not be reimbursed for the cost of those repairs.
There is a time limit on implied warranties
All implied warranties (including merchantability and fitness for a particular purpose) expire on the Warranty Expiration Date that is set forth on the signature page of this contract. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.
Deadline to make a limited warranty claim
Any warranty claim must be presented to Timbukthree 4WD before the Warranty Expiration Date set forth on the signature page of this document. If you attempt to make a warranty claim after the warranty period has expired – even if you believe you were experiencing issues before to the end of the warranty period – the warranty is still expired and void.
What is not covered by the limited warranty
This limited warranty does not include Timbukthree 4WD paying for any incidental or consequential damages that are incurred as a result of any warranty issue (including, but not limited to, lost income, towing charges, childcare expenses, public transportation/taxi/ride-share expenses, costs of a rental car, costs of replacing any property that is damaged if the rebuilt engine fails), or any issue that is determined not to be a warranty issue. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
What to do if a warranty issue is suspected
If you experience an issue you believe may be related to the engine, you must take the following steps:
- Undertake proper troubleshooting steps to attempt to make a determination as to the root cause of the issue being experienced.
- If the root cause of the issue is determined to NOT be related to the engine itself, perform any necessary repairs.
- If the root cause cannot be determined or is believed to be caused by the engine itself, call Timbukthree 4WD to describe the problem and troubleshooting steps taken thus far.
- If you desire for Timbukthree 4WD to perform a warranty claim inspection, the engine must be removed from the vehicle and returned to Timbukthree 4WD in the same condition in which it was delivered to you for Timbukthree 4WD to tear down, inspect, and diagnose the root cause.
- If Timbukthree 4WD determines the root cause of the issue is related to the engine itself and the necessary repairs are covered under your warranty, we will replace any parts and perform any necessary repairs and then re-assemble the engine at no cost to you.
- If Timbukthree 4WD determines the root cause of the issue is NOT related to the engine itself and/or if the necessary repairs are not covered under your warranty, you then have the option of whether you would like the engine returned to you in its torn down state, or whether you want Timbukthree 4WD to re-assemble the engine at your expense.
- If repairs to the engine itself are not covered under your warranty, Timbukthree 4WD is willing to repair the engine at your expense.
- Timbukthree 4WD does not at any time provide technical or troubleshooting support.
- Any direct or incidental costs incurred by the customer to install the engine and/or diagnose a suspected issue will not be covered or reimbursed by Timbukthree 4WD.
If you paid for delivery of the engine with your initial purchase, the cost of picking the engine up for a warranty claim inspection is covered under your warranty if the necessary repairs are also covered under your warranty.
If you cause damage to your engine or otherwise void your warranty, Timbukthree 4WD is willing to perform any necessary repairs and to restore the engine warranty for the remaining duration of original warranty period at your expense.
What to do if a warranty issue is diagnosed
- If the engine has a defect that is verified by Timbukthree 4WD to be the source of the problem, replacement parts will be provided free of charge, or you may choose to have Timbukthree 4WD perform the repairs at your expense.
- Labor costs (or monetary compensation for time spent) for initial installation of the engine, troubleshooting to diagnose a suspected issue, or to remove the engine once a customer desires to make a warranty claim are not covered by this warranty and will not be reimbursed.
- Labor costs (or monetary compensation for time spent) for anyone other than Timbukthree 4WD to repair the engine are not covered by this warranty and will not be reimbursed.
- Labor costs, any incidental or consequential damages (including, but not limited to, lost income, towing charges, childcare expenses, public transportation/ taxi/ride-share expenses), and any other direct or incidental expenses or damages incurred to install the replacement parts provided by Timbukthree 4WD are not covered by this warranty and you will not be reimbursed.
What to do if the warranty issue is not resolved after a reasonable number of efforts
If Timbukthree 4WD performs warranty work at your expense under this contract, but is not able to resolve the issue after a reasonable number of efforts, you will have the option of choosing a replacement part or a refund.
The limited warranty is void under certain circumstances
- All warranties are void under the following circumstances:
- If the required break-in procedure is not followed or completed,
- If negligent or unskilled installation of the engine causes damage to the engine,
- If the engine has been disassembled before our inspection (removal of valve cover and/or oil pan are not considered engine disassembly),
- If the center of either of the installed heat tabs has been melted (overheated) or removed,
- Unreasonable use or abuse of the engine,
- Act of God (such as a flood),
- Or if you have not performed reasonable and necessary maintenance.
- Reasonable and necessary maintenance means:
- After the break-in procedure has been completed and the vehicle is being driven for normal purposes, perform regular 3,000 mile/3 month oil changes, whichever comes first. The required oil for this engine is Shell Rotella – T4 SAE 15W40 (non-synthetic), or an equivalent brand name. Diesel truck motor oil is required because of the ZDDP (Zinc) content in the oil, which will protect the flat tappet camshaft throughout its life.
- Flush the cooling system if any sort of stop-leak has been used.
- Do not allow the engine to overheat. Overheating can be caused by many things such as a bad radiator, bad water pump, bad thermostat, any kind of clog or leak in the cooling system, cracked cylinder head, or an inoperable cooling fan. If your temperature gauge ever starts to rise past its normal temperature, pull over and turn the vehicle off immediately to prevent overheating.
- Take other actions reasonable under the circumstances.
- See additional details on actions that would void your warranty below.
The limited warranty cannot be transferred to anyone else
- You cannot transfer this limited warranty to anyone else. All engines are marked with Timbukthree 4WD’s markings and a serial number. Warranties are void in the following circumstances:
- If the serial number has been defaced,
- If the engine is removed and installed in another vehicle and/or
- If
there is a change in ownership of a vehicle in which a Timbukthree 4WD engine
has been installed
